Kentucky Rental Agreement

The Kentucky rental agreements are legal contracts written between a landlord and a tenant who wishes to use real property. The tenant makes regular compensatory payments (“rent”) in exchange. The agreements determine the terms for use of the property, but they must comply with Kentucky’s landlord-tenant laws.

 

Kentucky Residential Lease Agreement

A Kentucky residential lease agreement is between a landlord and a tenant for the renting of property for monthly rent and other obligations. Depending on the terms of the agreement, the landlord and tenant will be required to negotiate the following:

  • Monthly rental amount ($);
  • Utilities including:
    • Electricity;
    • Water;
    • Heat;
    • A/C;
    • Landscaping;
  • Parking fees;
  • Security deposit; and
  • Pet Deposit (if any)

Kentucky Month-to-Month Rental Agreement

The Kentucky month-to-month rental agreement allows a tenant to rent from a landlord for one month at a time with no end date. Typically, the landlord will collect a (1) one-month security deposit to ensure that rent will be paid and the responsibilities of the agreement are performed.

Kentucky Rental Application Form

The Kentucky rental application form allows a landlord to choose a viable tenant before beginning a lease or accepting rent. This form must be compliant with the Federal Fair Housing Act. A tenant’s credit, criminal, and rental histories may be considered during the application process.

Kentucky Roommate Agreement

The Kentucky roommate agreement (“room rental agreement”) is a contract between two or more tenants sharing the same rental property (“co-tenants”). This document details the financial obligations required of each co-tenant, as well as the terms and conditions of the shared space. All co-tenants must sign the contract.

Kentucky Commercial Lease Agreement 

AKentucky commercial lease agreement allows a landlord that owns retail, industrial, or office space to rent this space to a qualified tenant. There are many types of rental arrangements such as Triple Net (NNN), Gross, and Percentage leases that this contract may be modified to reflect as long as both parties are in agreement. Typically the tenant will make requests as to how they would like the space to be “fit-up” to their specific needs. The landlord will take this into account when negotiating the rental price (usually on a per square foot basis) and when the parties have come to a verbal agreement, this document will be completed with the appropriate terms. It is advised that the landlord demand a personal guaranty from the tenant if it is a new business.

Kentucky Security Deposit Laws

Maximum Amount ($) – There is no state limit on the amount a landlord can charge their tenants for a security deposit.

Returning – Security deposits must be returned within sixty (60) days of the lease termination date (§ 383.580(6)).

Kentucky Required Disclosures

Lead-Based Paint Disclosure – If the building was made before January 1, 1978, the tenant must initial this document that acknowledges the possible presence of lead-based paint on the premises.

Authorized Access – The landlord is required to describe any individuals that are allowed onto the property including the owner, building manager, and agents in the lease agreement (§ 383.585).

Move in/Move Out Checklist – Before the tenant moves in, they must visit the property with the landlord and mark any property defects or sign a document stating that they wish to waive this right (§ 383.580).

Security Deposit Location – If there is a security deposit, state law requires the landlord to disclose where the deposit is being held, along with the bank account number (§ 383.580).

Kentucky Rent Grace Period

Kentucky has no grace periods for rent payments. Rent must be paid at the exact time and place stated within the rental agreement (§ 383.565(2)).
