Arkansas lease agreements let a tenant enter into a binding agreement with a landlord for renting of commercial or residential property. The agreement is written after the rent has been negotiated and a rental application has been submitted. If approved, the tenant will be asked to sign and pay the 1st month’s rent, last month’s rent, and any security deposit.

The agreement is only valid every thirty (30) days and renews for another month every time the tenant makes the payment. Either party may void or change the terms of the contract with written notice (exact time of how much notice should be given is either in the original agreement or is one (1) month). It is always recommended to perform a credit check through an application with every new tenant.

Arkansas Commercial Lease Agreement 

The Arkansas commercial lease agreement can be used by a company or individual seeking to legally rent property from a landlord for business use. Typically, a landlord will determine the rent payment on a per-square-foot basis. A standard length for the contract is three (3) years but it may be any term as decided by the tenant and landlord. When executing the document, it is recommended that the signatures be witnessed by a notary public to protect both parties.

Arkansas Security Deposit Laws

Maximum Amount ($) – Cannot exceed two (2) months’ periodic rent (§ 18-16-304).

Returning – Deposit must be returned within sixty (60) days of the termination of the tenancy; however, the money becomes the landlord’s property if they are unable to locate the tenant one hundred eighty (180) days after payment was mailed (§ 18-16-305).

Lead-Based Paint – By federal law, this disclosure must be completed and signed if the property was constructed before January 1, 1978.

Arkansas Rent Grace Period

Arkansas statutes have implemented a five (5) day grace period. Tenants have five days after the rent due date to make the payment, after which, the landlord can terminate the agreement (§ 18-17-701).
